Terms of Service

1. About this agreement

These Terms of Service ("Terms") govern your use of Inkstract ("the Service"), operated by Inkstract ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Please also read our Privacy Policy and Cookie Policy, which form part of this agreement.

2. What the Service does

Inkstract processes handwritten documents — submitted as PDFs or images — using artificial intelligence to produce structured digital text in Markdown format. The Service also extracts bullet journal notation, preserves diagrams and sketches, and allows you to maintain a personal dictionary of abbreviations and terminology.

Processing results are generated by AI and may not be 100% accurate. Output may contain errors, omissions, or misinterpretations of handwritten content. You are responsible for reviewing and verifying all output before relying on it.

3. Eligibility

  • You must be at least 18 years old to use the Service.
  • You must provide accurate and complete registration information and keep it up to date.
  • By accepting these Terms you confirm that you meet these requirements.

4. Account responsibilities

  • You are responsible for maintaining the security of your account credentials. Use a strong, unique password and enable two-factor authentication where possible.
  • Your personal inbound email address is unique to you. Do not share it publicly or with untrusted parties, as documents sent to that address will be processed and added to your account.
  • You are responsible for all activity that occurs under your account. Notify us immediately at hello@inkstract.com if you suspect unauthorised access.
  • You are responsible for ensuring that the content you submit complies with these Terms and applicable law.

5. Acceptable use

You may not use the Service to:

  • Submit, process, or store content that is illegal, defamatory, fraudulent, or that infringes third-party intellectual property rights.
  • Attempt to abuse, overload, or disrupt the Service or its underlying infrastructure.
  • Reverse engineer, decompile, or attempt to extract the source code of any part of the Service.
  • Use automated scripts, bots, or other means to access the Service beyond the intended email ingestion functionality, without our prior written consent.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.

We reserve the right to determine, in our reasonable discretion, whether use violates these standards.

Prohibited content

The following content is strictly prohibited. Violation will result in immediate account termination and referral to relevant authorities:

  • Child sexual abuse material (CSAM) or any content depicting the exploitation of minors — we are legally obligated to report this to the National Crime Agency.
  • Content related to terrorism or the promotion of terrorist acts — we are legally obligated to report this under the Terrorism Act 2006.
  • Material that incites violence, racial hatred, or other criminal offences.
  • Content that infringes the intellectual property rights of others.
  • Material related to fraud, identity theft, or financial crime.
  • Any content that is illegal under the laws of England and Wales.

Where we become aware of prohibited content, we will preserve relevant data for law enforcement, terminate the account, and make reports as required by UK law. We may cooperate with law enforcement investigations without notifying the affected user where legally required or permitted to do so.

If you become aware of illegal content being processed through Inkstract, please report it to abuse@inkstract.com or use our abuse report form. We will investigate and take appropriate action including account termination and law enforcement referral where required.

6. Intellectual property

Your content. You retain all rights to the documents, notes, and other content you submit to the Service. You grant Inkstract a limited, non-exclusive, royalty-free licence to process, store, and display your content solely for the purpose of providing the Service to you. This licence ends when you delete your content or close your account.

We do not claim ownership of your content. We do not use your content to train AI models.

Our property. The Inkstract brand, name, logo, website design, codebase, and all other proprietary materials remain our exclusive property. Nothing in these Terms transfers any ownership of our intellectual property to you.

7. AI processing disclaimer

The Service uses artificial intelligence — specifically Anthropic's Claude API — to interpret and transcribe handwritten content. AI-generated output is probabilistic and may contain errors, omissions, or misinterpretations.

The Service is not designed or suitable for applications where accuracy is essential, including but not limited to medical records, legal documents, financial data, or safety-critical instructions. Do not rely on Inkstract output in these contexts without independent verification.

You are solely responsible for reviewing, verifying, and acting on any output produced by the Service.

8. Privacy and data

Our Privacy Policy explains in full how we collect, use, and protect your data. In summary:

  • Your processed content is encrypted at rest using per-user encryption keys.
  • Source files (your original PDFs and images) are deleted after processing according to your retention setting (default: immediately).
  • We do not use your content to train AI models.
  • The Service is hosted in the EU (Railway EU region; Cloudflare R2 EU).

9. Third-party integrations

You may optionally connect third-party services such as Todoist. When you do, data including extracted task text and document filenames is shared with those services.

  • Third-party services are governed by their own terms and privacy policies. Inkstract is not responsible for how third-party services handle your data.
  • You can disconnect any integration at any time from your account settings.

10. Subscription and payment

  • A free tier is available with a limited monthly page allowance. Paid tiers offer higher allowances and are billed monthly via Stripe.
  • You may cancel your paid subscription at any time. Access to paid features continues until the end of your current billing period. No refunds are provided for unused time within a billing period.
  • We may change our pricing at any time. For existing subscribers, we will provide at least 30 days' notice of any price increase before it takes effect.
  • All prices are stated in the currency displayed at checkout and are inclusive of any applicable taxes unless stated otherwise.

11. Data portability and deletion

  • You may export all your data at any time from your account settings. Exports include all processed Markdown, dictionary entries, and processing history.
  • You may delete your account and all associated data at any time from your account settings. Deletion is immediate and permanent.

12. Service availability

We aim to provide a reliable, high-availability service, but we do not guarantee uninterrupted access. The Service is provided "as is" and "as available".

We may perform maintenance that temporarily affects availability. We will endeavour to give reasonable advance notice of planned maintenance where possible, but this is not always feasible for emergency or security-related work.

13. Limitation of liability

To the maximum extent permitted by applicable law:

  • Inkstract's total aggregate liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the total fees paid by you in the 12 months immediately preceding the event giving rise to the claim.
  • We shall not be liable for any indirect, consequential, incidental, special, or punitive damages, including loss of profits, loss of data, or loss of goodwill, arising out of or related to the Service.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.

14. Termination

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have breached these Terms, are using the Service in a way that could cause harm, or for any other reason required by law.

You may terminate your account at any time by deleting it from your account settings. Termination does not affect any rights or obligations that accrued before termination.

15. Changes to these Terms

We may update these Terms from time to time. The date of the most recent update is shown at the top of this page.

For material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the Service after that date constitutes your acceptance of the updated Terms. If you do not agree to the changes, you should delete your account before they take effect.

16. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
